Introduction
The Excellence in Measurement Technology Privacy Policy describes the privacy practices of Excellence in Measurement Technology’s websites and software applications (“Services” or individually a “Service”). Your relationship is with Excellence in Measurement Technology, LLC (also referred to as "EMT", "we", "us" or "our") and the laws of Connecticut and the United States apply.
If you reside outside of North America, please note that in order to use our website and web applications, you authorize EMT to transfer your personal information across national borders and to other countries where EMT and its licensors and suppliers, including the United States. The privacy protections and rights of authorities to access your information in these countries may not be equivalent to those in your country. We will only transfer your personal information to these countries where permitted to do so by law and we will take steps intended to ensure that your personal information continues to receive appropriate protections. If the content or information that you store on the EMT website and web applications contains personal information of other individuals, you must be legally permitted to share the personal information with EMT.
Information We Collect from You
When you sign up to use Excellence in Measurement Technology Services or to access any content or material that is made available by Excellence in Measurement Technology through the Service ("Content"), EMT collects information that identifies you. This includes:
- Name;
- Email address;
- Types of Content of interest;
- Content of user support communications.
As a part of our continuing support and development of our Services and Content to provide to you, we may send you surveys, forms, or other opportunities to provide feedback if you are subscribed to our email mailing list. These may be used to collect additional information about you, including but not limited to your company name, country, and types of Services and Content you are interested in. Submitting this kind of feedback to EMT is completely optional.
EMT collects information about how you use our Services and access our content. This information may be anonymous or it may be associated with you. This information includes:
- IP address;
- Type of browser and device;
- Webpage that led you to the EMT website;
- Search terms entered into a search engine that led you to the EMT website;
- Use and navigation of the Services (collected through web analytics tools);
- Analysis of your content (e.g., activity logs, and direct feedback from you) which is sent or received through the EMT Services.
Emails
Emails we send you may include a technology (called a web beacon) that tells EMT whether you have received or opened the email, or clicked a link in the email. If you do not want us to collect this information, you can opt out of receiving EMT marketing emails.
Online advertising
Excellence in Measurement Technology advertises in a variety of ways, including displaying EMT ads through search engines and on social media platforms such as Facebook. These online advertising platforms collect the following information to measure the effectiveness of our advertising:
- Which ads are displayed;
- Which ads are clicked on;
- Where the ad was displayed.
Social media buttons, tools, and content from other companies
Excellence in Measurement Technology Services may include buttons, tools, or content that link to other companies’ services (for example, a Facebook "Like" button). We may collect information about your use of these features, such as content “liked” and address information in Google Maps. In addition, when you see or interact with these buttons, tools, or content, or view an EMT web page or software application containing them, some information from your browser may automatically be sent to the other company. Please read that company’s privacy policy for more information.
EMT has its own pages on many social networking sites (for example, the Excellence in Measurement Technology Facebook page). We will collect information which you have made publicly available on your social networking account, such as name and interests in our products and services, when you interact with our social networking pages.
Using Your Information
Excellence in Measurement Technology uses the information we collect about you for the folowing purposes:
- To fulfill a contract, or take steps linked to a contract: this is relevant where you register to use an EMT Service or access EMT Content. This includes:
- Providing you with the EMT Services or Content for which you have registered, and any other services or products that you have requested;
- Verifying your identity;
- Providing customer service or support.
- As required by EMT to conduct our business and pursue our legitimate interests, in particular:
- Providing you with the EMT Services or Content for which you have registered, and any other services or products that you have requested;
- Analyzing your use and measuring effectiveness of our websites and apps to better understand how they are being used so we can improve them and engage and retain users;
- Sending you information about EMT products and services, special offers and similar information;
- Diagnosing problems in our apps and websites;
- Conducting surveys and market research about our customers, their interests, the effectiveness of our marketing campaigns, and customer satisfaction (unless we need consent to undertake such surveys, in which case we will only do this with your permission);
- Investigating and responding to any comments or complaints that you may send us;
- In connection with legal claims, compliance, regulatory and investigative purposes as necessary (including disclosure of information in connection with legal process or litigation).
- Where you give EMT your consent or otherwise consistent with your choices:
- Sending you information about EMT products and services, special offers and similar information;
- Placing cookies and using similar technologies on our websites, on our apps and in email communications, in accordance with our Cookies Policy and the information provided to you when those technologies are used;
On other occasions where we ask you for consent, we will use the information for the purposes which we explain at that time. Legal reasons include responding to requests by government or law enforcement authorities conducting an investigation, and to detect, prevent, or otherwise address fraud, security or technical issues and software piracy (e.g., to confirm that software is genuine and properly licensed), helping to protect you as well as Adobe.
Sharing Your Information
Excellence in Measurement Technology will not share your personal information with third-parties for marketing or advertising purposes.
EMT will share personal information with companies, organizations, or individuals outside of EMT if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to detect, prevent, or otherwise address fraud, security, or technical issues, as well as to protect against harm to the rights, property, or safety of EMT, our users, or the public as required or permitted by law.
EMT will share your personal information with suppliers that help us to run our business by processing personal information on behalf of EMT for the purposes identified above. Such companies include providers of customer support services, fraud monitoring and prevention, email, social media, and other marketing platforms and service providers, and hosting services.
EMT may also share your personal information:
- when you agree to the sharing;
- when we are required to provide information in response to a subpoena, court order, or other applicable law or legal process;
- when we have a good faith belief that the disclosure is necessary to prevent or respond to fraud, defind our Services against attacks, or protect the property and safety of EMT, our customers, or the public;
- if we merge with or are acquired by another company, sell an EMT Service or business unit, or if all or a substantial portion of our assets are acquired by another company, your information will likely be disclosed to our advisers and any prospective purchaser's advisers and will be one of the assets that is transferred to the new owner.
Securing Your Information
We understand that the security of your personal information is important. We provide reasonable administrative, technical, and physical security controls to protect your personal information. However, despite our efforts, no security controls are 100% effective and Excellence in Measurement Technology cannot ensure or warrant the security of your personal information.
Storing Your Information
Your personal information and files are stored on Adobe’s servers and the servers of companies we hire to provide services to us.
Transferring Your Information Across National Borders
We may transfer your personal information across national borders to other countries in compliance with applicable laws. Whether you are a resident of or reside outside of North America, your relationship is with Excellence in Measurement Technology, LLC. Your personal information may be transferred to Excellence in Measurement, Ltd, which is located in the UK.
Your Rights Regarding Your Information
Under the law of some countries, you may have the right to ask us for a copy of your personal information; to correct, delete or restrict (stop any active) processing of your personal information; and to obtain the personal information you provide to us for a contract or with your consent in a structured, machine readable format, and to ask us to share (port) this information to another controller.
In addition, you can object to the processing of your personal information in some circumstances (in particular, where we don’t have to process the information to meet a contractual or other legal requirement, or where we are using the information for direct marketing).
These rights may be limited, for example, if fulfilling your request would reveal personal information about another person, or if you ask us to delete information which we are required by law to keep or have compelling legitimate interests in keeping (such as fraud prevention purposes).

Additionally, you can unsubscribe from our email marketing list by clicking the "unsubscribe" link aprovided in any of the marketing emails we send to you.
If you have unresolved concerns, you have the right to report them to an EU or other data protection authority where you live, work or where you believe a potential violation may have occurred.
To use some EMT Services or access some of our Content, the provision of some information is mandatory: if relevant information is not provided, then we will not be able to provide you with the Services or Content requested. All other provision of your information is optional. Providing optional information will help us offer you a better experience, such as more personalized or tailored content or offerings.
Retaining Your Infomation
When you subscribe to receive direct marketing from us, such as signing up to our email marketing list, we process and keep most personal information we have about you for as long as you are an subscriber. When you unsubscribe, we will remove you from the direct marketing lists you are unsubscrbing from (such as our email marketing list). However, we typically retain personal information related to our contract and business transactions with you for three years after your last interaction with us.
Where we process personal information for marketing purposes or with your consent, we process the information until you ask us to stop and for a short period after this (to allow us to implement your requests). We also keep a permanent record of the fact that you have asked us not to send you direct marketing or to process your information so that we can respect your request in future.
Changes to the Terms
Occasionally we may, in our discretion, make changes to our Privacy Policy. When we make material changes to the Privacy Policy, we’ll provide you with prominent notice as appropriate under the circumstances, e.g., by displaying a prominent notice within the Service or by sending you an email. In some cases, we will notify you in advance, and your continued use of the Service after the changes have been made will constitute your acceptance of the changes. Please therefore make sure you read any such notice carefully.
